By accessing or using Cramberry, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service. We reserve the right to modify these terms at any time, and your continued use constitutes acceptance of any changes.

2. Description of Service

Cramberry is an AI-powered study platform that transforms your study materials into comprehensive learning resources. You can upload documents (PDFs, Word, PowerPoint), images, audio recordings, YouTube links, and web URLs. Our AI generates study sets containing summarized notes, flashcards, multiple choice quizzes, short answer questions, practice tests, and key terms glossaries. Each study set includes an AI chat feature to help you understand your materials better. Our service includes progress tracking and mastery-based learning features.

3. Account Registration

To use Cramberry, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized account access
• Be responsible for all activities under your account
• Be at least 13 years old to use the service

4. Subscription and Payments

Cramberry offers both free and paid subscription tiers:

• Free Tier: 3 AI generations per study set (each content type counts as one generation), 10 AI chat messages per month, 5 study set edits per study set
• Pro Monthly ($14.99/month): Unlimited AI generations, unlimited AI chat messages, unlimited study set edits, priority support
• Pro Yearly ($89.99/year — 50% savings): All Pro features at $7.50/month when billed annually

Subscriptions automatically renew unless cancelled before the renewal date. Payments are processed securely through Stripe. Refunds are handled on a case-by-case basis.

5. User Content

You retain ownership of all content you upload to Cramberry. By uploading content, you grant us a limited license to:

• Process your materials using AI to generate study content (notes, flashcards, quizzes, etc.)
• Extract text from documents and images using OCR technology
• Transcribe audio recordings using speech-to-text technology
• Fetch and process content from YouTube videos and web links you provide
• Store your content securely on our servers
• Display your content back to you within the platform

You are responsible for ensuring you have the right to upload any content and that it does not infringe on any third-party rights.

6. Public Study Sets

You may choose to make your study sets publicly visible. By making a study set public:

• Your content (notes, flashcards, quizzes) will be viewable by anyone, including non-registered users
• Your study set will be indexed by search engines (Google, Bing, etc.)
• You grant Cramberry a non-exclusive, worldwide license to display and distribute the content
• Your username will NOT be publicly displayed (content is shown anonymously)
• Other users may learn from your content

By making content public, you represent and warrant that:

• You have the right to share this content publicly
• The content is original or properly licensed for redistribution
• The content does not violate any third-party intellectual property rights
• The content is appropriate for a general audience

Cramberry reserves the right to review, moderate, and remove any public content that violates these terms or our content guidelines. You can make your study set private again at any time, though cached versions may persist temporarily in search engines.

7. Acceptable Use

You agree not to:

• Upload illegal, harmful, or offensive content
• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Attempt to gain unauthorized access to our systems
• Use the service to distribute malware or spam
• Resell or redistribute the service without permission
• Use automated systems to access the service excessively
• Interfere with other users' use of the service

8. AI-Generated Content

Cramberry uses artificial intelligence to generate study materials and provide chat responses. While we strive for accuracy, AI-generated content may contain errors or inaccuracies. You should verify important information independently. We are not responsible for any consequences arising from reliance on AI-generated content.

9. Intellectual Property

Cramberry and its original content, features, and functionality are owned by Cramberry and are protected by international copyright, trademark, and other intellectual property laws. Our trademarks may not be used without prior written consent.

10. Termination

We may terminate or suspend your account at any time for violations of these terms or for any other reason at our sole discretion. Upon termination, your right to use the service ceases immediately. You may also delete your account at any time through your account settings.

11. Disclaimer of Warranties

Cramberry is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, secure, or error-free. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

To the maximum extent permitted by law, Cramberry shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the service. Our total liability shall not exceed the amount you paid us in the past twelve months.

13. Indemnification

You agree to indemnify and hold harmless Cramberry and its operators from any claims, damages, losses, or expenses arising from your use of the service, your violation of these terms, or your violation of any rights of a third party.

14. Governing Law

These terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of competent jurisdiction.
